You could probably do it based on challenge order if the resolution oracle also returned the calc for how much of the corresponding order should be covered by the bond - so calculates the capital in flight at time of order - and only pays out that much. Seems obviously worse though since the oracle has to determine merkle order anyways + it's nice to have the oracle simplicity of just matching merkle roots
